Terms
Thanks for choosing NorthNest Photo & Drone for your media needs! Before using our services, please read the following terms of service agreement carefully. This contractual agreement is between Blatz Creative LLC, doing business as "NorthNest Photo & Drone" (the "Company"), and the commissioning party (the "Client").
Acceptance of Terms By accessing or using NorthNest Photo & Drone's website or services, Client agrees to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our website or services.
Services NorthNest Photo & Drone provides real estate photography, aerial drone services, and video production to clients in Washington State. Our services include photographing residential and commercial properties, creating virtual tours, and providing aerial photography and videography. We strive to deliver high-quality services to our clients and will make reasonable efforts to ensure that all services are completed in a timely and professional manner.
Hosting Photos and media will be hosted via our delivery platform for 12 months from the date of delivery. After 12 months, Client is responsible for maintaining their own copies of all media assets.
Payment Payment for our services is due upon completion and delivery of photos and/or video projects. We accept major credit cards and electronic payments via our secure checkout system. If payment is not received, we reserve the right to withhold media assets until payment is complete.
Delivery Client will receive media digitally via our professional delivery platform (HDPhotoHub), email, or other agreed-upon electronic means. No physical media shall be delivered unless agreed upon by both parties. NorthNest Photo & Drone will not send out any raw or unedited media (including, but not limited to photo or video) and shall retain rights to all original content created.
Pricing NorthNest Photo & Drone reserves the right to change or adjust pricing at any time. Additional services may be added same day by the Client (pending availability from NorthNest Photo & Drone). If the wrong package was selected upon scheduling by Client or NorthNest Photo & Drone, NorthNest Photo & Drone reserves the right to (a) shoot and deliver only what was ordered, or (b) update the shoot to the Client's best needs with adjusted pricing. Pricing quotes from NorthNest Photo & Drone will be honored for 14 calendar days from quote delivery date.
Cancellation and Rescheduling Clients may cancel or reschedule appointments up to 24 hours prior to the scheduled time without penalty. If a cancellation or rescheduling request is made less than 24 hours before the scheduled appointment, a fee of up to $150 may be charged depending on services and drive time associated with the shoot. Rescheduling due to unsafe weather conditions (heavy rain, snow, high winds, low visibility, etc.) or FAA restrictions on drone operations will be at the sole discretion of NorthNest Photo & Drone and shall be of no charge to Client or NorthNest Photo & Drone. Both parties must come to mutual agreement upon a rescheduling date.
Copyright NorthNest Photo & Drone retains all rights to the photographs, videos, and other content produced by us. Clients may use the photographs, videos, and other content for personal or business use related to the marketing and sale of the photographed property, but may not sell, license, alter, re-edit, or distribute them to third parties without our written permission.
Retention of Intellectual Property Rights Unless otherwise agreed in writing, NorthNest Photo & Drone retains sole ownership and all intellectual property and other legal rights and interests of any nature whatsoever to any and all photographs, videos, or other products or services provided to the Client. NorthNest Photo & Drone shall have the unconditional right to publish and otherwise utilize all such products and services in connection with NorthNest Photo & Drone's marketing, advertising, and promotional efforts and endeavors.
Artistic License NorthNest Photo & Drone reserves full artistic license and shall have the sole and absolute discretion to choose and determine the process and manner whereby all photos, videos, or other media or services shall be created and produced. In the event the Client desires any specific vantage point and/or angles, background, or other specific element of the service, the same must be communicated prior to or during the scheduled service.
Grant of Limited License Client is hereby granted a limited and non-exclusive license to utilize the photographs, videos, or other products or services provided to the Client for standard and normal advertising and marketing purposes during the term of the Client's listing agreement respecting the real property which is the subject of the services provided hereunder. Limited license is granted for the term of the listing.
Liability NorthNest Photo & Drone is not liable for any damage or loss resulting from the use of our services or website. Clients assume all risks associated with the use of our services and agree to indemnify and hold us harmless from any claims arising out of the use of our services. NorthNest Photo & Drone carries appropriate liability insurance for all drone operations and on-site services.
Refunds Refunds will be considered on a case-by-case basis. If you are not satisfied with the service provided, please contact NorthNest Photo & Drone within 72 hours of delivery. In the event of a requested and approved refund, the Client agrees to cease use of all media assets for the subject project/property by NorthNest Photo & Drone immediately. Continued use of any and all assets created by NorthNest Photo & Drone after refund is in violation of Terms of Service.
Revisions Revisions of media/photos/content produced must be requested in writing by Client within 72 hours of media delivery. If no revisions are requested within 72 hours, Client acknowledges that media delivered is satisfactory for marketing needs. Minor revisions (color correction, cropping adjustments) will be completed at no additional charge. Major revisions requiring re-shooting will be quoted separately.
Day of Shoot Client properties shall be ready and available for NorthNest Photo & Drone to perform its duties on the time and date of appointment. Properties should be clean, staged, and accessible. In the event the Client property is being cleaned, staged, locked, or is otherwise inaccessible or unavailable for NorthNest Photo & Drone's scheduled services, then NorthNest Photo & Drone shall have the right to reschedule the service at the Client's sole cost and expense, including any applicable rescheduling fees.
Authority to Provide Access Client represents and warrants that Client has the legal right and authority to authorize NorthNest Photo & Drone and its employees and agents to enter upon, photograph, and take video of all interior and exterior portions of the subject property, including operation of drone equipment over and around the property.
Governing Law This agreement shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes arising from this agreement shall be resolved through mediation or binding arbitration in Spokane County, Washington, in accordance with the rules of the American Arbitration Association.
Amendments NorthNest Photo & Drone reserves the right to amend this agreement at any time. Clients will be notified of material changes via email. Your continued use of our services after notification of amendments constitutes your acceptance of the new terms.
Communications (SMS/Email/Phone) By agreeing to these terms of service, Client agrees to receive email confirmations about session scheduling, changes, and completions. You also agree to receive periodic emails/text messages with updates and occasional promotions from NorthNest Photo & Drone. You authorize NorthNest Photo & Drone to send SMS/email/voice calls about appointments, updates, and occasional promotions. Message frequency varies. Msg & data rates may apply.
